INTELLECTUAL PROPERTY RIGHT HOLDERS CONFIDENTIALITY
Russia has taken a significant step towards enhancing of intellectual property rights protection. The Government of the Russian Federation has adopted a new regulation that temporarily allows applicants, right holders and parties of transactions with intellectual property rights objects to declare that their data should not to be mentioned in the official bulletins of Rospatent.
According to the Decree of the Government of the Russian Federation of 02.09.2024 No. 1209, which entered into force on September 30, 2024 and is valid until December 31, 2025, "upon the request of the applicant who filed an application for state registration of an invention, utility model, design, trademark, computer program, database, integrated circuit topology ... , of the right holder ... , of the parties to the agreement on the disposal of exclusive rights ... the Federal Service for Intellectual Property will not publish information about the mentioned persons in the official bulletin." The goal of this ruling is to safeguard the interests of entrepreneurs and intellectual property owners who seek to keep important aspects of their business activities confidential and avoid potential unauthorized access to commercially valuable personal data.
The resolution may have a significant impact on the business environment in the country, ensuring confidentiality of individual and commercial interests of intellectual property entities. It is important to note that in order to use the new opportunities, right holders should submit a corresponding request to Rospatent simultaneously with an application for registration of an intellectual property object. Thus, the decree creates new horizons for intellectual property protection in Russia, creating a balance between information transparency and confidentiality of the parties concerned.
